Welcome to mychar.gg ("mychar", "we", "us", or "our"), operated by mychar, a sole proprietorship (eenmanszaak) registered in the Netherlands (KVK: 93940254, VAT: NL005053176B36), located in Breda, The Netherlands. These Terms of Service ("Terms") govern your access to and use of the mychar.gg website, platform, services, and any related applications (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

2.1 Account Creation

To access most features of the Service, you must create an account. You may register using:

Email and password
Third-party OAuth providers (such as Discord)

2.2 Username

Each account is associated with a unique username that forms your public profile URL (e.g., mychar.gg/your-username). Usernames must:

Be between 3 and 20 characters
Contain only lowercase letters, numbers, hyphens, and underscores
Not impersonate any person, brand, or entity
Not contain offensive, hateful, or misleading content

We reserve the right to reclaim, reassign, or suspend usernames at our discretion, including usernames that violate these Terms, infringe trademarks, or are inactive for an extended period.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

Provide accurate and complete information during registration
Keep your login credentials secure and not share them with others
Notify us immediately at support@mychar.gg if you suspect unauthorized access
Accept responsibility for all activity that occurs under your account

3. The Service

3.1 Description

mychar.gg is a link-in-bio platform designed for gamers and gaming communities. The Service allows you to create a personalized character page to showcase your gaming profiles, social links, clips, achievements, and other content.

The Service offers three subscription tiers (Free, Pro, and Elite), each providing different levels of access to features, upload limits, and customization options. See our pricing page for current plan details and pricing. Users may also create, save, and share skins (theme presets) that apply visual configurations to character profiles.

3.2 Character Profiles

Each user may create and maintain one character profile. Your profile is publicly accessible at your chosen username URL. You are solely responsible for all content displayed on your profile.

3.3 Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance, updates, or other operational reasons without prior notice.

4. Subscriptions and Payments

4.1 Free and Paid Tiers

The Service offers both free and paid subscription tiers. Free accounts include core features with certain limitations. Paid tiers ("Pro" and "Elite") unlock additional features as described on our pricing page. The Pro plan includes a 7-day free trial for first-time subscribers. Your payment method will not be charged until the trial period ends.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. By subscribing to a paid tier, you authorize us to charge your chosen payment method for the recurring subscription fee.

4.3 One-Time Payments

The Service may offer one-time payment options, such as donations that unlock achievements or badges on your profile. These payments are non-refundable and are processed through Stripe under the same terms as subscription payments.

4.4 Payment Processing

Payments are processed through Stripe, a third-party payment processor. Your payment information is handled directly by Stripe and is subject to Stripe's Terms of Service and Privacy Policy. We do not store your full payment card details on our servers.

4.5 Price Changes

We may change subscription prices at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following notice of the change. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.6 Downgrade and Grace Period

When you downgrade your subscription to a lower tier, any content or media that exceeds the limits of your new plan will be locked for a 7-day grace period. During this grace period, you may upgrade again to retain your content. After the 7-day grace period expires, content exceeding the new plan's limits will be automatically deleted. We recommend downloading any content you wish to keep before the grace period ends.

4.7 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

Your paid features will remain active until the end of the current billing period
Your account will revert to the free tier after the billing period ends
No partial refunds are provided for unused portions of a billing cycle

4.8 EU Right of Withdrawal

If you are a consumer residing in the European Union or European Economic Area, you have a statutory 14-day right of withdrawal for online purchases. However, by subscribing to a paid tier and beginning to use the paid features of the Service, you expressly consent to the immediate performance of the Service and acknowledge that you lose your right of withdrawal once the digital content has been fully provided or the service has commenced with your prior express consent. For free trials, the right of withdrawal applies until the trial converts to a paid subscription.

4.9 Refunds

Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at support@mychar.gg within 14 days of the charge.

5. User Content

5.1 Your Content

"User Content" refers to any content you upload, post, display, or otherwise make available through the Service, including but not limited to: profile information, display names, biographies, avatars, links, gaming clips, video clips, audio files and playlists, custom fonts, custom cursors, background images and effects, skins (theme presets), and any other material.

You retain ownership of your User Content. By posting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service. This license terminates when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

5.2 Shared Skins

When you create a skin (theme preset) and make it publicly available, you grant other users of the Service a non-exclusive, royalty-free license to apply and use that skin on their own character profiles. You may remove a shared skin at any time, but users who have already applied it may continue to use the settings it contained.

5.3 Content Restrictions

You agree not to post, upload, or share any User Content that:

Is unlawful, harmful, threatening, abusive, harassing, defamatory, or hateful
Promotes violence, discrimination, or hatred against any individual or group
Contains sexually explicit material involving minors
Infringes any patent, trademark, copyright, or other intellectual property right
Contains malware, viruses, or any harmful code
Is deceptive, fraudulent, or misleading
Violates any person's privacy or publicity rights
Promotes illegal activities, including but not limited to drug use, hacking, or fraud
Contains spam, phishing, or unsolicited commercial content
Impersonates any person or entity, or falsely states or misrepresents your affiliation

5.4 Content Moderation

We reserve the right, but are not obligated, to review, monitor, and remove any User Content at our sole discretion. We may remove content that violates these Terms or that we deem inappropriate, without prior notice.

5.5 DMCA and Copyright Complaints

If you believe your copyrighted work has been used on the Service without authorization, please submit a notice to legal@mychar.gg with the following information:

Identification of the copyrighted work claimed to be infringed
Identification of the material that is claimed to be infringing and its location on the Service
Your contact information (name, address, phone number, email)
A statement that you have a good faith belief that the use is not authorized
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
Your physical or electronic signature

6. Prohibited Conduct

In addition to the content restrictions above, you agree not to:

Use the Service for any illegal purpose or in violation of any applicable law
Attempt to gain unauthorized access to the Service, other user accounts, or our systems
Interfere with or disrupt the Service or servers connected to the Service
Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent
Reverse engineer, decompile, or disassemble any part of the Service
Create multiple accounts for deceptive, abusive, or fraudulent purposes
Sell, resell, or commercially exploit the Service or access to it without authorization
Use the Service to send spam, chain letters, or unsolicited messages
Circumvent any rate limiting, access controls, or security measures
Artificially inflate profile views, statistics, or any other metrics

7. Third-Party Services and Integrations

7.1 Linked Platforms

The Service allows you to link to third-party platforms (such as Discord, YouTube, Twitch, Steam, Kick, X, Instagram, Spotify, and others). We are not responsible for the availability, content, or practices of any third-party platform.

7.2 Discord Integration

When you authenticate through Discord, you authorize us to access certain account information as described during the authentication process. Your use of Discord authentication is also subject to Discord's Terms of Service and Privacy Policy.

When you connect your Discord account, you authorize us to access your Discord profile information (user ID, username, display name, avatar, and public badges). If you opt in, we will also use your Discord OAuth token with the guilds.join scope to add you to the mychar.gg Discord server. Your subscription tier may be synced as a Discord role, and certain achievements may be verified through your Discord guild membership status.

8. Intellectual Property

8.1 Our Rights

The Service, including its design, code, features, branding, logos, and documentation, is owned by mychar and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

8.2 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

9. Termination

9.1 By You

You may delete your account at any time through your account settings. Upon deletion:

Your profile and associated data will be removed
Your username will be released for others to claim
Active subscriptions will be cancelled (no refund for the remaining period)

9.2 By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice, if:

You violate these Terms or our Acceptable Use Policy
Your use of the Service poses a risk to other users or our systems
We are required to do so by law
We discontinue the Service or any part of it

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to: intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.

WE DO NOT WARRANT THAT:

THE SERVICE WILL MEET YOUR REQUIREMENTS
THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
ANY INFORMATION PROVIDED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE
ANY DEFECTS WILL BE CORRECTED

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYCHAR, ITS OWNER, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) €100 EUR.

12. Indemnification

You agree to indemnify, defend, and hold harmless mychar and its owner, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of a third party

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before filing any formal dispute, you agree to first contact us at support@mychar.gg and attempt to resolve the matter informally within 30 days.

13.3 Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.

13.4 EU Consumers

If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence. You may also be entitled to bring proceedings in the courts of your country of residence. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

Update the "Last Updated" date at the top of this page
Notify you by email or through a notice on the Service

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
